The employer has an obligation to keep and preserve records of compliance. 29 U.S.C. § 2616(b). Records regarding the FMLA that must be kept are:
- payroll information
- dates or hours of leave
- copies of notices of leave
- employer policies regarding paid or unpaid leave
- records of any dispute
