The MoAPA contains little reference as to who should be a party. It merely sets forth the notice requirements once the parties have been determined or designated. Section 536.067, RSMo 2000.
The PSC Law (see §9.2, supra) provides the PSC with broad discretionary authority to designate parties. By rule, the PSC has attempted to define the interest necessary to be a party. The PSC may deny intervention absent a showing that:
the petitioner has an interest different from that of the public; or
the intervention would serve the public interest.
