D. (§11.8) Scope and Application of Law
The MTML applies to transfers to custodians for minors if the transfer expressly refers to the Missouri law and if at the time of the transfer the:
donor or transferor is a resident of Missouri; minor is a resident of Missouri; custodian is a resident of Missouri; or custodial property is situated in Missouri.
See In re Klineman, 430 N.Y.S.2d 24 (N.Y. Surr. Ct. 1980), for a case involving jurisdiction of Surrogate Court in the county where the minor’s custodial property was situated.
