F. (§11.8) Form and Contents of Application for Transfer

Before drafting an application for transfer, counsel should review Rule 83.05 in detail to be aware of any recent changes in the Court’s requirements. This is very important because “failure to set out necessary matters with accuracy, brevity and clearness shall be a sufficient reason for denying the application.” Rule 83.05(b).

At the time of publication, Rule 83.05 set the following requirements for an application for transfer:

· The application may not exceed 12 pages.

· The first page must set out the reasons for requesting transfer. Counsel should specifically set out “the questions of general interest and importance, the existing law that requires reexamination, and the opinions of the appellate courts” that...
