8. (§11.62) Mandated Reporting

Counsel should be familiar with the mandated reporting statute, § 198.070, RSMo Supp. 2009. Under § 198.070.1, mandatory reporters include, among others:

· health care providers;

· long-term care facility employees and adult day care workers;

· employees of governmental agencies that deal with health care or senior citizens;

· law enforcement personnel;

· ministers;

· social workers; and

· coroners, embalmers, and funeral directors.

These individuals must, if they have reasonable cause to believe that a facility resident is being abused or neglected, immediately report that belief to MoDHSS. Failing to so report is a class A misdemeanor. Section 198.070.1 and .3. The report must include:

· the facility name and address;

· the resident’s name;

· information about the abuse or neglect;

· the reporter’s name; and

· any other helpful information.
