B. (§11.49) Missouri Sections Not in Uniform Transfers to Minors Act

Section 404.007(8), (10), (11), and (17), RSMo 2000, contains definitions for “[d]onor,” “[g]uardian,” “[i]ncapacitated person,” and “[p]roperty.” The definition of “[b]enefit plan” is expanded.

Section 404.018, RSMo 2000, states that a person who holds property as a custodian assumes the obligation to administer in accordance with the law.

Section 404.027.1, RSMo 2000, authorizes a donor to give another person the power to designate a custodian independent of the power to designate the recipient of a gift.

Section 404.031.2, RSMo 2000, authorizes a minor to transfer property to a custodian.

Section 404.035, RSMo 2000, requires a custodian to have the same qualifications as a conservator under § 475.055, RSMo 2000.
