D. (§11.46) Example of Custodial Trust Agreement

Polly M. Thompson Custodial Trust

This Instrument constitutes the written agreement between Roger M. Thompson and Patricia M. Thompson, Donors, and John H. Thompson, Custodial Trustee, and Kathryn Thompson, Successor Custodial Trustee, of property delivered to the custodial trustees under the Missouri Transfers to Minors Law, Chapter 404, Revised Statutes of Missouri, to hold and manage for Polly M. Thompson, beneficiary.

1. Name of Custodial Trust: Polly M. Thompson Custodial Trust UTML-MO U/A 5/16/06.

2. Custodial Trust Donors: Roger M. Thompson, Grandfather, and Patricia M. Thompson, Grandmother.

3. Name in Which Custodial Property Held: John H. Thompson, Custodial Trustee for Polly M. Thompson, UTML-MO U/A 5/16/06.

4. Custodial Trust Beneficiary: Polly M. Thompson, born November 22, 2003, Jackson County, Missouri, Social Security Number xxx-xx-xxxx.

5. Initial Custodial Trustee: John H. Thompson, Custodial Trustee for Polly M. Thompson under the Missouri Transfers to Minors Law. Relationship to custodial trust beneficiary: father.

6. Designated Successor Custodial Trustee: Kathryn Thompson, First Successor Custodial Trustee. Relationship to custodial trust beneficiary: mother. Other successor custodial trustees are as appointed by the acting custodial trustee under § 404.057, RSMo 2000, by executing and dating an instrument of designation before a subscribing witness other than the successor custodian.

7. Custodial Trust Property: The sum of $1,000 from Donors, receipt of which is hereby acknowledged by the custodial trustee, to be held for the custodial trust beneficiary indefeasibly under the Missouri Transfers to Minors Law and such other property that may be delivered to the custodial trustee, the ownership of which is indefeasibly vested in the beneficiary.
