A. (§11.43) Distribution to Custodian Under Will or Trust, §§ 404.016, 404.027.1, 404.047.1(4), and 404.057.1, RSMo
Clause A
If any person entitled to receive a distribution of property [under this Will] [from this trust] has not attained 21 years of age at the time of distribution, I direct that my [personal representative] [trustee] deliver the property to a custodian for the minor under the Missouri Transfers to Minors Law or similar minor’s custodian law of any state where the minor then resides and give to my [personal representative] [trustee] in [his] [her] individual capacity and not in [his] [her] representative or fiduciary capacity the power to designate any adult person or financial institution, including my [personal representative] [trustee], as custodian for the property distributed to each such minor under that law.
Note: “Individual capacity” is used to avoid any implication that the designation of a custodian by the person acting...
