C. (§11.36) Establishing Foundation

Once the state sufficiently establishes the corpus delicti, it must lay the proper foundation to introduce the statement. This testimony should come from the principal interrogating officer and should include a precise description of the circumstances surrounding the taking of the statement, including:

· the fact that Miranda v. Arizona, 384 U.S. 436 (1966), warnings were given and waived;
