H. (§11.30) Liabilities of Custodian and Minor
The MTML provides that “[a] minor is not personally liable for an obligation arising from ownership of custodial property or for a tort committed during the custodianship unless the minor is personally at fault.” Section 404.067.3, RSMo 2000. This is not a spendthrift clause and does not insulate custodial property from obligations owed by the minor in either tort or contract.
