II. (§11.2) Should Counsel Seek Further Review?
When should counsel ask for a rehearing by the panel or for an en banc hearing? The guidelines for each court are discussed in the respective sections below. But some pertinent generalizations can be made.
Counsel should not ask for a rehearing very often. A rehearing should not be sought out of emotional reaction to a loss or solely in response to a losing client’s demand.
