B. (§11.15) Miranda v. Arizona: Fifth Amendment Right to Counsel

This chapter attempts to only provide basic information concerning Miranda v. Arizona, 384 U.S. 436 (1966). In its decision, the Supreme Court went far beyond the specific facts of the case and included a lengthy discussion of modern interrogation techniques and the need for procedural safeguards to protect an accused’s constitutional rights. The Court limited its holding to situations of custodial interrogation. General on-the-scene questioning was not affected by the decision. Id. at 478.
