I. (§11.138) Trial Issues—Voir Dire
Voir dire in nonsupport cases presents some interesting choices for counsel. In State v. Reed, 181 S.W.3d 567 (Mo. banc 2006), the defendant made a Batson challenge to the state’s peremptory removal of seven members of the jury panel—all of them male.
Batson v. Kentucky, 476 U.S. 792 (1986), held that a party in a criminal trial is prohibited by the United States Constitution from using a peremptory strike to remove a prospective juror solely on the basis of race.
