5. (§11.13) Family Allowances and Refusal of Letters

Support and family allowances may be allowed from the estate of a nonresident decedent in Missouri. Section 473.675(3), RSMo 2000. These allowances are governed by the more liberal of the laws of Missouri or of the decedent’s domicile. Id. Section 473.675(3) requires that the Missouri court to which this application is made must take into account allowances that may be made in other states and satisfied from property located in the other states.
