Section 10 Notice by Eligible Employee

When possible, an eligible employee must provide 30 days’ notice for foreseeable leave. 29 U.S.C. § 2612(e). Failure to provide timely notice for foreseeable leave may result in a delay of the requested leave. 29 C.F.R. §§ 825.304(b) and 825.312(a). Alternatively, the employer may waive employees’ FMLA notice obligations or the employer’s own internal rules on leave notice requirements.
