A not-unusual situation occurs when a person is injured by the act of a person with whom the person has no privity and the intervening party is virtually judgment-proof. In such a case, the facts must be scrutinized carefully to determine if there existed, between the person with whom the plaintiff had contact and the person outside privity with the plaintiff, a conspiracy to defraud the plaintiff.
