1. (§10.8) Personal Treatment

The common law doctrine of informed consent encompasses the right of a competent individual to make health care treatment decisions. In Missouri, an adult patient has the legal authority to make any personal treatment decision. But although the patient may have the legal authority to consent, the secondary issue is whether the patient has the capacity to consent, which is discussed in §10.7 above.
