IV. (§10.44) Jury Instructions

In State v. Gilmore, 797 S.W.2d 802 (Mo. App. W.D. 1990), the court reviewed decisions that have unequivocally rejected the argument that it is error for a trial court to refuse to submit additional cautionary jury instructions, concerning eye witnesses, modeled after those contained in United States v. Telfaire, 469 F.2d 552 (D.C. Cir. 1972), especially when the Missouri Approved Instructions adequately present the defendant’s theory of innocence. See:
