1. Motion Proponent

The party moving for summary judgment bears the initial burden of informing the court of the grounds for the motion and indicating what parts of the pleadings, depositions, interrogatory answers and admissions on file, and affidavits, if any, support the motion. The movant also must establish that no trial is required and that judgment should be granted as a matter of law because no genuine issue of material fact exists.1390 The movant can meet this initial burden by presenting evidence to show that no material fact is in dispute or that the other party has failed to present evidence to support an element of its case on which it bears the ultimate burden of proof.1391

If the movant fails to meet the initial burden described above, summary judgment must be denied. The motion will be denied regardless of the quality or lack thereof of the opposing party’s papers.1392
