The purpose of a writ of habeas corpus is to inquire into the cause of the restraint of a person’s liberty. Rule 91.01. Chapter 532, RSMo, pertains to habeas corpus proceedings. Rule 91 supersedes statutes that are in conflict. See Rule 41.02.
Under Mo. Const. art. I, § 12, suspension of the privilege of the writ of habeas corpus is prohibited.
Courts are not required to issue a writ of habeas corpus when there are other adequate remedies at law. Covey v. Moore, 72 S.W.3d 204, 209 (Mo. App. W.D. 2004).
