The Occupational Safety and Health Act of 1970 (“the Act”), Pub. L. No. 91-596, 84 Stat. 1590, is designed to ensure safe and healthful working conditions for employees. 29 U.S.C. § 651. The Act, in conjunction with applicable regulations, imposes a number of obligations on employers with respect to workplace safety and health.
The Act is enforced by the Secretary of Labor (“the Secretary”),
