A. (§1.57) Intention to Create Trust

An intended settlor wishing to establish a trust must first have an intention to create a trust and must properly manifest this intent at that time. Restatement (Third) of Trusts § 13 (2003). This manifestation of intent may be oral only if the trust property is personal property. See:
