g. (§1.36) United States v. L.C. Chapman

The United States v. L.C. Chapman, 281 F.2d 862 (10th Cir. 1960), court reached the same result as the Aquilino v. United States, 176 N.E.2d 826 (N.Y. 1961), court in ruling in favor of a subcontractor against the IRS and a bank. The dollars in dispute in Chapman, however, were retainage dollars rather than progress payments. The case involves a private owner and does not involve surety law.
