D. (§1.34) Contractual Obligations
An agreement to represent a party in a dispute, including a trial if necessary, does not include an obligation to pursue an appeal, absent an explicit provision to do so. But some retainer contracts describe the lawyer’s commitment as for “trial, appeal and re-trial, if any.” Such a commitment may not be wise; it certainly is not necessary.
