1. (§1.31) Generally
If consideration consists of legal detriment to the promisee, if
the promisee does only what the promisee is already legally obligated to do, that act is not consideration. Thus, a husband’s promise to support his wife is not consideration for his wife’s promise to pay him a sum of money. In re Wood’s Estate, 232 S.W. 671 (Mo. banc 1921).
