1. (§1.3) Aggrieved

The client must be aggrieved by the decision. Section 512.020, RSMo 2000, provides: “Any party to a suit aggrieved by any judgment of any trial court in any civil cause . . . may take his appeal.” This is construed liberally. In re Estate of Dugan, 309 S.W.2d 137 (Mo. App. S.D. 1957).

The client may be aggrieved when:

· the judgment is rendered against the client on any count;

· any of the client’s claims or counterclaims are dismissed; or

· the judgment is for less than that for which prayer was made.

Most difficult cases about being aggrieved seem to arise when there is a question about the client’s status as a party.
