C. (§1.27) Collection and Contribution—General Rules

Section 537.067, RSMo Supp. 2013, substantially limits joint liability for tortfeasors. A tortfeasor is jointly and severally liable only if the tortfeasor is found to be 51% or more at fault. A tortfeasor who is less than 51% at fault is liable only for the tortfeasor’s proportional share of fault. The consequence of the statute may not be disclosed to the trier of fact.
