G. (§1.18) Service of Process—Impeachment

In 1984, the legislature amended Rule 54.22 by an act specifically addressed to that purpose. The legislatively amended Rule provides that the “return of service shall be considered prima facie evidence of the facts recited therein.” By virtue of the 1986 amendment of § 472.141, RSMo 2000, coupled with the provisions of Rule 41.01(d), there seems to be but little question that Rule 54.22 automatically applies to every adversary probate proceeding as well as to any other proceeding cognizable before the probate division.
