F. (§1.17) Service of Process

Before August 13, 1986, the provisions of the Civil Code did not apply to adversary probate proceedings. Before that time, service of process in adversary probate proceedings was governed by § 472.100, RSMo, and by Rule 41.01(d), which provided that “[w]here the Probate Code contains provisions for a method of service, service may be made pursuant to the Probate Code or as provided by Rule 54.”

In 1985, what is now § 506.150, RSMo 2000, was amended by the addition of provisions permitting service of summons and petition by registered or certified mail. There is, of course, nothing new in permitting service of process by mail. Section 506.160, RSMo 2000, permits mail service in in rem actions.
