4. (§1.13) Expert Testimony
Section 490.065.3, RSMo 2016, imposes an independent duty on trial judges to determine whether the facts and data relied on by a given expert witness are reasonably reliable. State Bd. of Registration for Healing Arts v. McDonagh, 123 S.W.3d 146, 153–57 (Mo. banc 2003). Whether expert opinion testimony satisfies the requirements of § 490.065.3 is left to the trial court’s discretion.
