3. (§1.12) Jury Instructions

Jury instructions must be grounded on the admitted evidence and any reasonable inferences from it. State v. Westfall, 75 S.W.3d 278, 280–81 (Mo. banc 2002). If the evidence tends to establish a party’s theory or supports differing conclusions, that party is entitled to an instruction. Id. at 280; State v. Taylor, 944 S.W.2d 925, 936 (Mo. banc 1997); State v. Hobson, No. SD 34195, 2016 WL 5851908 (Mo. App. S.D. Oct. 6, 2016).
