Rule 802 Hearsay Rule

Hearsay is not admissible except as provided by applicable constitutional provisions, statutes, or rules.

Comment

This rule provides that hearsay is inadmissible except as allowed by constitutional provisions, statutes,[1] exceptions contained in Rules 104(a), 803, and 804 of the Rules of Evidence,[2] or other rules of procedure. If hearsay evidence is admitted without objection, it becomes competent evidence admissible for all purposes, unless its admission amounts to fundamental error.[3] Hearsay evidence that is improperly admitted may be harmless error, which is usually the case when there is other competent evidence on the same point.[4]
