RULE 16. CONTINUING JURISDICTION

The family court has jurisdiction of the parties and control of all subsequent proceedings from the time of service of the summons and complaint.

Division of Property

A family court does not have jurisdiction to modify a division of property. It can modify an order only when jurisdiction was specifically reserved in the decree or if allowed by statute. Hayes v. Hayes, 312 S.C. 141, 439 S.E.2d 305, 307 (Ct. App. 1993).
