HANDLING FEDERAL DISCOVERY

HIGHLIGHTS
Revision 24 of Handling Federal Discovery addresses the seismic shift in federal discovery caused by the
once-in-a-generation COVID-19 pandemic. Courts and practitioners alike have had to quickly adopt new technologies,
and adapt to shifting circumstances as technology continues to change discovery practices. Some would argue these
changes were long overdue. For example, this Revision addresses the new paradigm in remote depositions which, once
a rare occurrence, has now become part of what many courts call “the new norm.” See Task 61.
Revision 24 also again adds nearly 100 new (and recently decided) cases, replacing older cases that no longer
reflect modern federal discovery practice, and further highlights the impact of the pandemic on different aspects of
federal discovery. Practitioners can continue to find a dedicated focus on evolving jurisprudence as well as an updated
practical guide on how to anticipate and successfully navigate federal discovery in the post-pandemic world.
