PREFACE
This handbook is the result of two actions taken by the Section of
Antitrust Law of the American Bar Association about twenty years apart.
The first was the publishing of the ANTITRUST DISCOVERY HANDBOOK in
1981. This handbook incorporates parts of that handbook in the sample
discovery section contained in chapter 8. The second action was a
Continuing Legal Education program sponsored by the Section of
Antitrust Law called “Discovery In Antitrust Litigation” in February
2000. The papers from that seminar provided the foundation for most of
the chapters included in this book.
The contributors to the “Discovery In Antitrust Litigation” program
and to this book are Geraldine M. Alexis, Timothy J. Burke, Joan
Feldman, Christopher B. Hockett, Margaret E. Guerin-Calvert, R. Mark
McCareins, Darrell L. Williams, Harry M. Reasoner, Edward C.
Duckers, Carole E. Handler, Allan Van Fleet, Steven C. Holtzman, Rick
Pepperman, Tim Frazer, Aimee Imundo, Thomas J. Rosch, the
Honorable Lee H. Rosenthal, Jeffrey A. LeVee, Hal Marcus, Edward D.
Cavanaugh, and the Honorable Sarah S. Vance.
Assistant Editors on this project include Professor Jagdeep Bhandari,
Mark A. Robertson, and David Steinman. Additional assistance in the
preparation of the handbook was offered by Jim Herbison, Ivan Poullaos,
Joyce Bishop, Thomas McCormick, Patrick Lee, Jennifer Laser, Lori
Cox, and Doracina Anderson. We would also add a note of thanks to
Elise Kirban and Greg Wrobel of the Publications Committee, and James
Wilson, Publications Officer, for their careful attention to the Handbook.
In addition, the ABA Section of Antitrust Law Publication, Antitrust Law
Developments (5th ed.) was used to provide context to certain categories
of discussion of general discovery topics in this Handbook.
The earlier ANTITRUST DISCOVERY HANDBOOK was prepared by a
special Task Force of the Civil Practice and Procedure Committee. The
members of that Task Force were Michael M. Baylson, Editor; Thomas
N. Burnham and Edward C. Schmidt, Assistant Editors; and Ernest J.
Altgelt III, L. Richard Freese, Jr., Warwick R. Furr II, Ray V. Hartwell,
John B. Lashbrook, Maurice J. McSweeney, and Robert C. Wright.
