PREFACE
The Exemptions and Immunities Committee of the American Bar
Association’s Antitrust Law Section is pleased to present the t hird edition
of this handbook, The Noerr-Pennington Doctr ine. This handbook focuses
on public policy issues arising from the antitrust treatment of efforts to
petition government or influence government activities, including
petitioning efforts that are themselves collective or anticompetitive. In
creating this book, we have relied heavily upon and been guided by the
Section’s 1993 and 2009 monographs on the same subject.
The Exemptions and Immunities Committee, currently co-chaired by
Melissa H. Maxman and Vittorio E. Cottafavi, coordinated the preparation
of this handbook. Committee vice chairs David J. Shaw and Stephen M.
Medlock were principally responsible for editing the handbook and
overseeing the revision of early drafts into a finished work. Craig Minerva
and Katherine Clemons, vice chairs of the Section’s Books and Treatises
Committee, provided invaluable comments and support throughout this
process and deserve credit for shepherding the project to completion.
Tiffany Brown, Megan Gerking, William Haun, Meytal McCoy, Katherine
Monks, Oral Pottinger, Saurabh Prabhakar , Micah Stein, an d Lauren Willard
prepared early drafts, while Katherine Monks, Oral Pottinger, and Meytal
McCoy made substantial contributions to the finished work. Substantive
work on the handbook was completed during the tenure of Christine
Sommer and Robin Moore as Chairs of the Books and Treatises Committee.
