PREFACE

The American Bar Association Section of Antitrust Law is pleased to

issue this third edition of its State Antitrust Enforcement Handbook. This

book analyzes how state attorneys general enforce state and federal

antitrust law. Information on state antitrust enforcement is often more

difficult to find than comparable information on federal enforcement

practices. This Handbook helps fill that gap.

The Section’s State Enforcement Committee gratefully thanks the

dedicated authors who drafted the updated chapters of this book. Zach

Biesanz, Colin Fraser, Nicole Gordon, Robert Hubbard, Arindam Kar,

David Kerwin, George Laevsky, Jamie Manning, Amy McFarlane,

Jonathan Mark, Emily Myers, David Paavola, Dan Sanchez, Crystal

Utley Secoy, Kayna Stavast-Piper, Jennifer Thomson, Anita Walker, and

Saami Zain all deserve praise for their insight and draftmanship.

The Committee also thanks its previous co-chairs, Vic Domen and

Tracy Wertz. Under their leadership and dogged determination, this

project was launched and brought to a successful completion.

Stephen D. Feldman ably and energetically led the preparation of this

third edition. The Section thanks Stephen, as well as his colleagues

Wendy Arends, Liz Brady, Anne Schneider, and Jenny Schwab, for

promptly editing the entire book to a high standard. The Section also

acknowledges Stephen, his colleagues Troy Shelton and Teri Rodriguez,

and everyone at Ellis & Winters who helped make this edition possible.

The Section’s Books & Treatises Committee, especially Anna

Walker, offered important guidance on this project.

Finally, the Section offers continuing thanks to Robert L. Hubbard,

who conceived this book, edited its first edition, and drafted updated

chapters of this edition. The new edition is a continuing tribute to Bob’s

contributions to state antitrust law, and the Antitrust Section.
