Payton v. County of Kane, 308 F.3d 673 (7th Cir. 2002). Arrestees brought an action against two county jails that charged a bond fee, above and beyond the set bail amount, as a condition of their release. The district court dismissed the action and the arrestees appealed. The appeals court reversed and remanded. The appeals court held that the arrestees sufficiently satisfied their standing requirement by alleging violation of their Eighth and Fourteenth Amendment rights. The court noted that the arrestees suffered monetary injury when they were required to make the extra payments, and that these injuries could be traced to the policy of each jail.
