Pate v. Peel, 256 F.Supp.2d 1326 (N.D.Fla. 2003). A state inmate brought an action against a prison nurse practitioner, alleging retaliation in violation of the First Amendment and deliberate indifference to his known serious medical conditions in violation of the Eighth Amendment. The district court granted summary judgment in favor of the nurse. The inmate had filed a grievance challenging denial of a medical pass for his bashful bladder syndrome (BBS).
