Petitioner is eligible for the requested Order because the offense for which Petitioner was convicted was Driving While Intoxicated under Texas Penal Code §49.04, which is a misdemeanor, but not a misdemeanor under Texas Penal Code Chapters 20, 21, 22, 25, 42, or 46, or an offense under §49.04(d).

Petitioner has successfully complied with the applicable waiting period.

Petitioner has not been placed on deferred adjudication community supervision for or been previously convicted or placed on any other deferred adjudication that would render Petitioner ineligible for this nondisclosure.
