Form of Objection
· The witness is reading from or relying on the document and not testifying from present recollection.
· The witness does not believe the material offered to refresh the witness’s recollection is correct.
· Witness is not testifying on direct.
General Rule
· A witness may testify on direct from present recollection. If it appears that the witness’s memory is faltering, the witness’s memory may be refreshed after consulting any writing (which witness reads silently)...
