Form of Objection
· Question is leading and suggestive.
· Counsel is leading the witness, and the witness is not hostile.
· Question is not in a form designed to elicit admissible facts.
General Rule
· Questions asked during direct examination that have the effect of suggesting the answers are improper when the witness is disposed to being led, with broad discretion in the trial court to allow the question. The leading question is designed to have the witness “echo back” the answer. McClelland v. Ozenberger, 841 S.W.2d 227, 231 (Mo. App. W.D. 1992).
