same time and place, the defendant entered the in-
tersection against a red light and struck the plaintiff’s
vehicle.
The plaintiff’s allegations of negligence against the
defendant were failing to obey a red light, failing to
keep a proper and adequate lookout, failing to safely
and properly enter an intersection and disregarding
traffic lanes, patterns and other devices. The plaintiff’s
complaint stated that he suffered pain and injury to
his neck, back and knee. The defendant denied neg-
ligently entering the intersection and denied that the
plaintiff sustained any serious or permanent injury in
the collision.
The board of arbitrators found in favor of the
defendant.

Allegheny County, PA
The plaintiff was injured in a motor vehicle
collision when the defendant made negligent left
hand turn and struck the plaintiff’s vehicle. The
defendant admitted liability, but denied that the
plaintiff sustained any serious or permanent
injury in the collision.
On December 12, 2013, the male plaintiff was oper-
ating his vehicle southbound on 16th, Street in Pitts-
burgh, Pennsylvania. At the same time, the
defendant was operating a truck in the course and
scope of his employment with the defendant com-
pany, northbound on 16th Street. The defendant at-
tempted a left turn and collided with the plaintiff’s
vehicle.
The plaintiff maintained that the defendant was negli-
gent in failing to ensure that movement of the vehicle
could be done safely, failing to make maneuvers to
avoid colliding with the plaintiff’s vehicle, attempting
to make a left turn when it was unsafe to do so and
being inattentive and failing to observe with care traf-
fic conditions. As a result of the collision, the plaintiff
suffered an aggravation of degenerative changes at
L1-2, an aggravation of a disc bulge at L3-4, an ag-
gravation of a disc protrusion L4-5 and L5-S1, head-
aches, right leg pain, back pain and anxiety and
depression. The defendant stipulated liability, but de-
nied that the plaintiff sustained any serious or perma-
nent injury in the collision and maintained that the
defendant had an extensive history of back com-
plaints on was on disability from those complaints at
the time of this collision.
The jury found that the defendant’s negligence was a
cause of harm to the plaintiff and the jury awarded
the plaintiff $125,000 in damages.

The plaintiff in this vehicular negligence action
maintained that she suffered serious and
permanent neck injuries when her car was struck
on the driver’s side front by the defendant who
making a negligent left-hand turn. The defendant
denied being negligent and argued that it was the
actions of the plaintiff that caused the accident.
On October 1, 2012, the female plaintiff was operat-
ing her vehicle southbound on Middle Road at the in-
tersection of Wildwood Road extension in Hampton
Township, Pennsylvania. At the same time and place,
the defendant was traveling northbound on Middle
Road when he attempted a left turn onto Wildwood
Road extension striking the plaintiff’s vehicle on the
driver’s side front.
The plaintiff’s complaints of negligence against the
defendant driver were failing to yield the right-of-way,
failing to properly observe traffic and conditions sur-
rounding him, causing his motor vehicle to strike the
plaintiff’s motor vehicle and improperly crossing the
center line of the highway. As a result of the collision,
the plaintiff sustained serious injuries to her neck
including a C5-6 disc bulge and C6-7 disc herniation
