In this vehicular negligence action, the plaintiff
maintained she sustained serious injuries to her
neck back and shoulders when she was lawfully
proceeding through an intersection with the green
light and was struck by the defendant who
entered the intersection against a red light. The
defendant entered a general denial of all
allegations of negligence and injury and
maintained that it was the actions of the plaintiff
that caused or contributed to the accident.
On January 8th, 2019, the female plaintiff was lawfully
proceeding on Pierce St at its intersection with Chartres
Street in Houston, Texas. The defendant was traveling on
Chartres Street when the defendant disregarded a red
light and entered the intersection striking the plaintiff’s
vehicle.
The allegations of negligence against the defendant
contained in the plaintiff’s petition were failing to keep a
proper and adequate lookout, failing to regard a steady
red traffic light, entering the intersection against a traffic
control device and failing to make maneuvers to avoid
striking the plaintiffs vehicle. Consequently, the plaintiff
sustained serious injuries to the disks of the cervical
thoracic and lumbar spine.
The court found in favor of the plaintiff and awarded the
plaintiff past medical expenses of $53,619.54 and past
pain and suffering of $35,000 for a total of $88,619.54.

Defendant negligently enters intersection lawfully
occupied by minor’s host vehicle, broad-siding
host vehicle – Neck and back pain.

A settlement was reached between the parties, in
this motor vehicle negligence case, after the
plaintiffs alleged that the minor child suffered
injuries to her neck and back when her vehicle
was T-boned by the defendant when the
defendant failed to yield the right-of-way to the
host vehicle. The defendant generally denied all
allegations of negligence and injuries. The
plaintiff parents were also injured in the collision
butarenotpartofthiscompromise.
On May 10, 2018, the 3-year-old female minor was a
rear-seat restrained passenger in a vehicle being oper-
ated by her parent. The vehicle was lawfully traveling
through an intersection when the defendant failed to
yield the right-of-way, striking the plaintiff’s vehicle.
The plaintiffs maintained that the defendant driver was
negligent and failing to yield the right-of-way, failing to
appreciate traffic lanes patterns, failing to make ma-
neuvers to avoid striking the plaintiff’s vehicle, failing to
properly apply the brakes and failing to keep a proper
and adequate look at period as a result of the collision
the minor plaintiff sustained injuries to her neck and
back.
The parties settled their dispute for $1,900.
