PRACTICE TIP:
It is important to require the trial court to place a continuing duty on the prosecution to reveal the existence
of oral statements purportedly made by defendant. Oral statements of defendant are often discovered by the
prosecution during trial preparation and also during trial, and counsel must take steps to make sure that they
are immediately furnished to the defense.
