plaintiff’s decedent, dropping her – Leg fracture.

The daughter of the decedent brought this
medical malpractice suit against the nursing home
where her mother resided claiming that the
defendants staff failed to do a proper 2-person
assist transfer of the decedent dropping her or
causing the decedent to fall. The fall resulted in a
leg fracture. The decedent died from unrelated
causes prior to the initiation of this suit and the
daughter brought this claim for survival damages.
The defendants denied all allegations of
negligence and injury.
At the time of the decedent’s admission to the defen-
dant nursing home, the 75-year-old female was des-
ignated as a 2-person assist which required 2
employees of the defendants to assist the plaintiff at
all times when she was to be moved from or to her
bed, from or to her wheelchair, and from or to a
stretcher. On August 20, 2016, the patient was being
transported from her bed by one of the defendant’s
nurses, aids or staff when the plaintiff was dropped or
fell to the ground sustaining injury.
As a result of the fall, the plaintiff’s decedent sus-
tained a fractured leg. In addition, the plaintiff al-
leged that from December 2016 through June 2017,
the decedent developed bed sores on her body as
a result of ineffective, delayed and inappropriate
wound care in treatment of the decedent. The plain-
tiff died from unrelated causes prior to the initiation of
this action and the estate only made a claim for sur-
vival. The estate alleged that the defendant nursing
home was negligent and failing to properly assist the
decedent in a transfer, failing to provide two people
to transfer the decedent, failing to rotate or turn the
decedent on a regular basis in order to prevent pres-
sure wounds, and providing substandard nursing
home care to the plaintiff’s decedent. The decedent
is survived by her adult daughter.
The parties settled for $75,000.

Daycare center negligence – Minor toddler falls
and breaks his leg while under care of defendant
daycare – Tibia/fibula fracture.

In this action, the parents of the minor male sued
the minor’s daycare when they picked up their
son and were told he fell and hurt his leg. The
parents took their son to the hospital where he
was diagnosed with a leg fracture. The defendant
generally denied all allegations of negligence and
injury.
On April 5, 2018, the 21-month-old male suffered a
fall at defendant day care center located Arbutus Av-
enue in Horsham, Pennsylvania, sustaining a leg frac-
ture. The plaintiff’s parents took the minor to a local
E.R. where he was diagnosed with a left distal tibia
and mid-shaft fibula fracture. The plaintiffs main-
tained that the defendant was negligent in failing to
properly supervise the activities of the minor, failing to
provide a safe daycare, and failing to employ ade-
quate staff.
The parties settled for $45,000.
