The quest to enforce our civil rights often leads us to the courts, and in
turn, into the litigation process. When civil rights plaintiffs elect to seek
redress in the courts for civil rights grievances, they need attorneys who
are not only thoroughly familiar with the applicable statutes and case law,
but who are also competent litigators and, if need be, trial and appellate
attorneys. It is one thing to know the law, but quite another to effectively
convey to the court such that it supports and accomplishes the civil rights
plaintiffs’ goals. To better equip lawyers who want to be effective civil rights
advocates, this section on litigation focuses on some important aspects of
litigation procedure, considerations for initiating a case, handling opposing
counsel, some general tricks of the trade I have learned during my years in
practice as a litigator, and more.
