which legal questions are resolved. Even issues of policy are governed by earlier
decisions. Were it not for Mapp and Miranda which created policy in their
respective legal quarters, the docket of the Court would have a very different
appearance. Because of the need to maintain minimum predictability and
consistency in the law, history is made very slowly. The Warren Court will be
with us for some years yet, even after the deaths of the five still active survivors.
The Warren Court did not end with the Chief Justice’s resignation nor with his
death. Its policies will remain as the initial point of deliberations for many years
to come.
