Other States Pass .08 BAC

I was disappointed to see that the July/August 2001 issue of State Legislatures did not include Alaska among those states that passed 2001 laws to lower the blood alcohol content (BAC) to .08. ("Lowering the limit, state by state," page 15.)

During the 2001 legislative session, Alaska passed House Bill 132 that has .08 provisions. It was signed by the governor in July and the stricter BAC went into effect Sept. 1.

It is my intention to work further on this issue during our 2002 session. We still need to address the other outstanding drunk driving issues: sentences, fines, forfeiture, etc.

Editor's note: Since the July/August magazine was printed, Alaska, Arizona, Georgia, Indiana, Missouri, and Oklahoma passed .08 BAC legislation bringing the total count of states with this provision to 28, plus D.C. and Puerto Rico. Louisiana has also passed a .08 law, but it is not effective until September...
