Lawyer disbarred after CSC conviction.

A Farmington Hills attorney was disbarred by an Attorney Discipline Board panel after he was convicted of criminal sexual conduct.

The disbarment of Daniel Scott Carlson, P 71918, (MiLW No. 12-100439, 1 page) was effective June 5. He has been continually suspended from practice since May 31, 2018, the date of his felony conviction.

The case was assigned to Tri-County Hearing Panel No. 52, which included chairperson Colleen V. Ronayne and members Julie McCann O'Connor and Scott A. Wolfson. Cynthia C. Bullington represented the Attorney Grievance Commission while John A. Carlson represented Daniel Carlson.

On Aug. 20, 2018, the grievance administrator filed a Notice of Filing of Judgment of Conviction stating that Daniel Carlson was convicted of criminal sexual conduct, 3rd degree (incapacitated victim), a felony, in People of the State of Michigan v. Daniel Scott Carlson in 49th Circuit Court, according to the hearing panel report. His law license was automatically suspended on his conviction date.

The first hearing date was adjourned by stipulation of the parties, as they tried to reach a settlement. A second scheduled hearing date was adjourned at Daniel Carlson's request because he was scheduled to appear for a hearing on his motion for a new trial in Mecosta County Circuit Court. Two more hearings were adjourned as the parties worked on submitting a stipulation for a consent order of discipline, the report stated.

The parties submitted a Stipulation for Consent Order of Disbarment on March 22, 2019.

"The stipulation contains respondent's admission that he was convicted as set forth in the Judgment of Conviction. The parties have agreed that respondent shall be disbarred from the practice of law. The hearing panel has considered the stipulation and has concluded that it is reasonable and is consistent with the goals of these discipline proceedings," the report stated.
